Rental Agreement
These terms and conditions (the “Agreement”) are a legal agreement between you (the “Customer”, “you” or “your”) and The Carré (“we,” “us,” “our,” or “The Carré”), establishing the terms and conditions on which you will submit information to, rent handbags (each a “Product” and collectively, “Products”) and receive related services (“Services”) from The Carré via our website at thecarre.com (the “Site”).
PLEASE READ THIS AGREEMENT CAREFULLY. BY SUBMITTING AN ORDER FOR PRODUCTS OR OTHERWISE ACCESSING OR USING ANY PART OF THE SITE OR SERVICES, YOU AGREE TO BE BOUND BY THIS AGREEMENT (INCLUDING THE SITE TERMS OF SERVICE AND PRIVACY POLICY). IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS AGREEMENT, DO NOT PLACE AN ORDER AND YOU WILL NOT BE PERMITTED TO RENT PRODUCTS FROM THE CARRÉ.
The Products and Services are controlled or operated from the United States of America and are not intended to subject The Carré to any non-U.S. jurisdiction or law. You may not use the Services to rent or purchase Products outside of the United States. Any use of the Site is at your own risk and you must comply with all applicable laws, rules and regulations. The Carré may limit Product or Service availability at any time, in whole or in part, to any person, geographic area or jurisdiction in its discretion.
The Carré reserves the right, at its sole discretion, to change, modify, add or remove portions of the terms of this Agreement at any time. Changes apply to rentals placed after the updated effective date. It is your responsibility to check this Agreement periodically. This Agreement applies every time you submit an order for Products or otherwise use our Services.
1. The Carré Rental Service
Subject to your compliance with this Agreement, The Carré permits you to rent Products by placing an order through the Site, paying the applicable charges for the rental term (the “Term”), and arranging delivery to the shipping address specified on your order. You acknowledge that you are renting the Product and that ownership of all Products remains with The Carré at all times, unless otherwise expressly provided in writing.
2. Registration; Eligibility; Limits; Approval Rights; Newsletter
Registration. Before using The Carré rental services you must register for an account through the Site. By registering you authorize The Carré to obtain information from your credit profile, identity verification providers, and other third-party sources to confirm your identity and prevent fraud. The Carré may require verification and reserves the right to perform such checks at any time an order is placed. You agree to provide true, accurate, current and complete information and to maintain and promptly update your account information if it changes. If you provide false or incomplete information, The Carré may suspend or terminate your account and refuse future use of the Services.
Eligibility. By renting Products you represent and warrant that you:
- are at least 18 years of age;
- are a legal resident of the United States;
- maintain a valid U.S. billing and shipping address; and
- are authorized to use the selected payment method.
We may require emailed or uploaded proof of identity and address.
Limits. The Carré may limit the number of rentals available to a single account, payment card, billing or shipping address, or otherwise restrict or cancel orders in its sole discretion.
Approval Rights. All rental orders are subject to review and approval by The Carré. We reserve the right, in our sole discretion, to approve, decline, or cancel any order on a case-by-case basis for any reason, including but not limited to risk assessment, inventory availability, account history, or suspected fraud. If an order is declined or canceled, any charges or authorizations will be released in accordance with your financial institution’s policies.
Newsletter. By opting into our newsletter you consent to receive communications from The Carré as described in our Privacy Policy.
3. Rental Fees; Payment Methods; Authorizations
Rental Fees. The Rental Fee for Products is displayed on the Site and includes the per-item rental amount and any published delivery charges. By placing an order you authorize The Carré to charge your payment card for the Rental Fee, shipping charges, applicable taxes, and any other charges arising under this Agreement. Rental Fees are charged at the time your rental order is verified.
Payment Methods. We accept Visa, MasterCard, American Express and Discover. Cash, checks, prepaid cards, debit cards and PayPal are not accepted unless otherwise stated.
Payment Authorizations & MSRP Hold. At booking you authorize The Carré to pre-authorize or charge an amount up to the Manufacturer’s Suggested Retail Price (“MSRP Value”) of the Product (plus applicable taxes) to secure against loss, theft, non-return, or substantial damage. The Carré will only charge amounts beyond the Rental Fee in the circumstances described in this Agreement, including but not limited to damage, loss, theft, late returns, or non-return.
If a card is declined or becomes invalid while Products are in your possession, you must update payment details immediately. Failure to do so may result in cancellation of your rental or require the immediate return of Products, and you agree to pay any collection costs (including reasonable attorneys’ fees).
4. Delivery; Billing & Shipping; Receipt; Shipping Policies
Delivery. Products are shipped via a carrier selected by The Carré to the address on your order and may be subject to additional delivery charges. After dispatch you will receive an email with tracking information. Delivery timing and fees vary by inventory, destination and other factors; The Carré does not guarantee delivery times.
Billing and Shipping Address. Billing and shipping addresses must match unless The Carré approves otherwise in advance. Contact us at info@thecarre.com for assistance.
Receipt of Products. An adult signature is required on delivery. Risk of loss transfers to you upon confirmed delivery. If delivery cannot be confirmed, contact The Carré immediately so we may initiate a tracer investigation. Tracer investigations typically take 8–12 business days; until results are available the rental period may be temporarily suspended.
Shipping Policies. Additional shipping policies are posted on the Site and incorporated herein.
5. Rental Term; End of Term Return; Extensions
Rental Term. The Term begins on the carrier’s confirmed delivery date and ends on the date the Product is scanned by the carrier for return shipment. Terms are measured in calendar days. If a return date falls on a weekend or holiday when carriers are closed, the next business day will be used for calculation.
End of Term Return. You must return the Product in the original Return Packaging and with all accessories by 12:00 PM (noon) on the return date identified on your order invoice. Products must be returned in the same condition as delivered (ordinary wear excepted). Failure to comply may result in additional charges as described in this Agreement.
Extensions. Extensions may be requested by email prior to the original return date and are subject to availability and prepayment of additional Rental Fees.
6. Use of Products; Cleaning; Loss, Theft or Damage; Non-Return; Suspected Non-Original Items
Care & Use. Products offered for rent are new or gently used. Color may vary due to photography or display settings. You agree to handle Products with care and to preserve protective coverings and hardware. Products are for personal use only and may not be sublet, loaned, used for commercial purposes, or modified.
Cleaning Fee. If a Product is returned stained, odorous, or excessively soiled, The Carré may charge a cleaning fee (minimum $100) as reasonably determined.
Damage Beyond Normal Wear. You are responsible for damage beyond normal wear and tear. If a Product is returned damaged beyond normal wear, you will be charged for repair or replacement costs up to the MSRP Value, as determined by The Carré in its reasonable discretion. Do not attempt repairs yourself.
Loss or Theft. In the event of loss, theft, or mysterious disappearance, you must notify The Carré immediately. You will be responsible for the full MSRP Value and Rental Fees may continue to accrue until the matter is resolved.
Non-Return / Late Return. Late returns may incur additional fees. If a Product is not returned within seven (7) days after the return date, The Carré will deem the Product non-returned and may charge up to the full MSRP Value plus applicable taxes and fees.
Suspected Non-Original Items. If The Carré reasonably determines that the item returned is not the same item originally rented or is not the original item, The Carré may charge you for the full MSRP Value and take any further action permitted by law.
7. Payment of MSRP Value
The Carré will not charge more than the full MSRP Value plus the Rental Fee in aggregate for amounts arising under this Agreement (excluding reasonable collection costs). If you pay an amount equal to the full MSRP Value and still possess the Product, the Product is yours to keep on an “AS-IS” basis without warranty.
8. Returns & Refunds
Rental fees are non-refundable once the rental term begins. No refunds, exchanges or compensation will be provided for early termination except where The Carré materially breaches this Agreement.
9. Collections
If you fail to pay amounts due, The Carré may pursue collection procedures. You agree to pay all collection costs, including reasonable attorneys’ fees, court costs, and interest as permitted by law.
10. Disclaimer of Warranty (INCLUDING AUTHENTICITY)
THE PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE CARRÉ DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.
The Carré does not guarantee or warrant the authenticity of any Product.
11. Limitation of Liability
EXCEPT WHERE PROHIBITED BY LAW, THE CARRÉ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE CARRÉ’S TOTAL LIABILITY SHALL NOT EXCEED THE RENTAL FEES PAID BY YOU FOR THE APPLICABLE PRODUCT.
12. Indemnification
You agree to defend, indemnify and hold harmless The Carré and its affiliates, officers, employees and agents from any claims, damages, liabilities, and expenses arising from your use of the Services or breach of this Agreement.
13. Miscellaneous
This Agreement constitutes the entire agreement between you and The Carré. It is governed by the laws of the State of [Insert State], without regard to conflict of law principles. The Carré may amend this Agreement at any time. If any provision is found unenforceable, the remaining provisions will remain in effect.
The Carré is not liable for delays or failures caused by events beyond its control, including carrier delays, natural disasters, or other force majeure events.
